ORDINANCE 193-07
AN ORDINANCE ESTABLISHING THE SPEED LIMIT ON SHARON STATION ROAD IN THE TOWNSHIP OF UPPER FREEHOLD IN THE COUNTY OF MONMOUTH AND STATE OF NEW JERSEY
WHEREAS, the Township Engineering firm Schoor DePalma prepared a report of speed data collected, dated September 20, 2006 and forwarded to the New Jersey Department of Transportation their recommendation to re-establish the Speed Limit on a portion of Sharon Station Road in Upper Freehold Township and on October 17, 2007, the Township Engineering Firm of CMX (formerly Schoor DePalma) prepared an addendum to that report dated October 17, 2007, adding further supporting data for the reduction of the speed limit (copies are attached hereto and made a part hereof).
BE IT ORDAINED BY THE MAYOR AND TOWNSHIP COMMITTEE of the Township of Upper Freehold, in the County of Monmouth and State of New Jersey, that by adoption and approval of this Ordinance :
Section 1. That the speed limits for both directions of traffic along Sharon Station Road between County Route 539 and County Route 526 be established as follows:
35 Miles per Hour
Section 2. Regulatory and warning signs, conforming to the current Manual on Uniform Traffic Control Devices for Streets and Highways, shall be erected and maintained to effect the above designated speed limit.
Section 3. All Ordinances or parts thereof which are inconsistent with or in conflict with this Ordinance or any part hereof are hereby repealed to the extent of said inconsistency.
Section 4. If the provisions of any Section, subsection, paragraph, subdivision or clause of this Ordinance shall be adjudged invalid by a Court of competent jurisdiction such Order or Judgment shall not affect or invalidate the remainder of any Section, subsection, paragraph, subdivision or clause of this Ordinance or any other Ordinance which is referred to herein by reference and to this end the provisions of this Section, subsection, paragraph, subdivision or clause of this Ordinance are hereby declared to be severable. Should any clause, sentence or other part of this Ordinance be adjudged invalid by a Court of competent jurisdiction such Judgment shall not affect, impair or invalidate the remainder of this Ordinance.
Section 5. This Ordinance shall take effect upon its passage and publication according to New Jersey law as to the speed limits as set forth herein the Township Committee of Upper Freehold Township upon passage of this Ordinance and publication directs its Township Clerk/Administrator to submit, for approval, a certified copy of this Ordinance to the Commissioner of the Department of Transportation. Unless notified otherwise within 90 days of receipt by the Office of the Commissioner of Transportation, the Ordinance shall then be deemed effective.
