ORDINANCE 187-07

 

AN ORDINANCE OF UPPER FREEHOLD TOWNSHIP IN THE COUNTY OF MONMOUTH AND STATE OF NEW JERSEY ESTABLISHING A CODE OF CONDUCT FOR INDIVIDUALS ATTENDING, COACHING, OFFICIATING, OR PARTICIPATING IN A YOUTH SPORTS EVENT ON UPPER FREEHOLD TOWNSHIP PROPERTY .

WHEREAS, THE TOWNSHIP COMMITTEE OF UPPER FREEHOLD TOWNSHIP, has considered a request by its Recreation Committee for a Code of Conduct to be enacted for individuals attending, coaching, officiating, or participating in a youth sports event on Upper Freehold Township property, and those individuals shall conform their behavior to the following code of conduct.

NOW, THEREFORE BE IT ORDAINED BY THE MAYOR AND TOWNSHIP COMMITTEE OF UPPER FREEHOLD TOWNSHIP IN THE COUNTY OF MONMOUTH AND STATE OF NEW JERSEY as follows:

Section 1. THE TOWNSHIP COMMITTEE OF UPPER FREEHOLD TOWNSHIP, has considered a request by its Recreation Committee for a Code of Conduct and has evaluated the request and deems that a Code of Conduct be enacted for individuals attending, coaching, officiating, or participating in a youth sports event on Upper Freehold Township property.

Section 2. The Code of Conduct shall appear as follows:

CODE OF CONDUCT

Preamble:

Interscholastic and youth sports programs play an important role in promoting the physical, social and emotional development of children. It is therefore essential for parents, coaches, and officials to encourage youth athletes to embrace the value of good sportsmanship. Moreover, adults involved in youth sports events should be models of good sportsmanship and should lead by example by demonstrating fairness, respect, and self-control.

I therefore pledge to be responsible for my words and actions while attending, coaching, officiating, or participating in a youth sports event and shall conform my behavior to the following code of conduct:

I will not engage, nor will I encourage my child, or any other person, to engage in un-sportsmanlike conduct with any coach, parent, player, participant, official, or any other attendee.

I will not engage, nor will I encourage my child, or any other person, to engage in any behavior which would endanger the health, safety, or well -being of any coach, parent, player, participant, official, or any other attendee.

I will not encourage or use, nor will I permit my child, or any other person, to encourage or use drugs or alcohol at a youth sports event.

I will not encourage, nor permit my child, or encourage any other person, to attend, coach, officiate, or participate in a youth sports event while under the influence of drugs or alcohol.

I will treat and encourage my child to treat any coach, parent, player, participant, official or any other attendee with respect regardless of race, color, creed, national origin, sex, sexual orientation, or ability.

I will not engage, nor will I encourage my child, or any other person, to engage in the use of profanity.

I will not engage, nor will I encourage my child, or any other person, to engage in verbal or physical threats or abuse aimed at any coach, parent, player, participant, official, or any other attendee.

I will not initiate, nor encourage my child, or any other person, to initiate a fight or scuffle with any coach, parent, player, participant, official, or any other attendee.

I hereby agree that if I fail to conform my conduct to the foregoing while attending, coaching, officiating or participating in a youth sports event I will be subject to disciplinary action issued by a league, organization, or school official who is authorized to issue such action by a school board or youth sports organization, including but not limited to the following in any order or combination there of:

Verbal warning issued by a league, organization or school official.

Written warning issued by a league, organization or school official.

Suspension or immediate ejection from a youth sports event.

Suspension for multiple youth sports events.

Season suspension or multiple season suspension.

All of the above will be submitted in writing to the school board, the Upper Freehold Township Recreation Committee, and distributed to each youth sports organization.

Section 3. It is the intention of the Township that all those who attend, coach, officiate, or participate in a youth sports event on Upper Freehold Township property sign this Code of Conduct.

Section 4. The Township directs its Clerk/Administrator pursuant to law to publish such "Notice" as may be required by law including without limitation N.J.S. 40:49-6 as to Publication and Notice and any Hearing as to this Ordinance.

Further, the Clerk/Administrator of the Township is required to take steps to record a certified copy of this Ordinance in the Monmouth County Clerk’s Office pursuant to law and including N.J.S. 40:67-21.

Section 5. All Ordinances or parts thereof that are inconsistent with or in conflict with this Ordinance or any part hereof are hereby repealed to the extent of said inconsistency.

Section 6. Should any clause, sentence or any other part of this Ordinance be adjudged invalid by a Court of competent jurisdiction such judgment shall not affect or impair or invalidate the remainder of this Ordinance which shall continue in full force and effect.

Section 7. This Ordinance shall take affect after final passage and publication as

required by law.
